Summer Woodson Berg left Big Law in the Big Apple to join The Law Offices of Bovino & Associates in Aspen, Colorado in early 2010. Ms. Berg’s practice focuses on real estate transactions and finance, litigation, trusts, estates, and probate matters. Ms. Berg also has experience with entity formation and general contract and commercial transactions.

Ms. Berg represents parties in all phases of acquisition, disposition, zoning and development of commercial and residential properties, including drafting contracts, easements and leases, performing due diligence, and facilitating closings. On the finance end, Ms. Berg has represented both borrowers and lenders in negotiation of mortgages, construction loans, mezzanine and other types of secured loans. Ms. Berg also guides clients through the Pitkin County Land Use Code and New York City’s Uniform Land Use Review Procedure, the public review and approval processes mandated for zoning changes, special permits, disposition of city-owned property, mapping of streets, urban renewal plan changes, and other discretionary land use procedures.

Ms. Berg’s background in litigation has proven to be a great asset in achieving favorable results for clients through the court systems, arbitration, and mediation. Ms. Berg has litigated in the courts of New York, Arizona, Colorado, and California in the following areas: business and contract matters, breach of fiduciary duties, trust accountings, medical malpractice, indemnification, negligence, general torts, construction defect, shareholder derivative and class actions, will contests, guardianship and conservatorship.

Prior to joining The Law Offices of Bovino & Associates, Ms. Berg worked several years as an associate at the international law firm Troutman Sanders in New York City. Ms. Berg was also a summer associate at Faruqi and Faruqi, where she represented plaintiffs in bringing shareholder derivative and class action lawsuits in courts across the country. Throughout law school, Ms. Berg served as a legal intern for the NYC Department of Buildings, the city agency charged with regulation of zoning and interpretation of the Zoning Resolution. Ms. Berg was also a legal intern at the New York Attorney General, Bureau of Real Estate Finance, during Elliot Spitzer’s term. Before attending law school, Ms. Berg worked as a lobbyist in Arizona representing a multitude of clients in every industry at the state capital. Ms. Berg also worked as a paralegal for the Phoenix real estate and construction litigation law firm, Eckley and Associates, where she assisted a team of litigators in bringing actions against real estate developers.

Counsel to national retailer in the acquisition and development of multiple big-box shopping center locations and expansions in New York

Counsel to borrower acquiring a limited service hotel in New Orleans and a mortgage of $12,000,000

Counsel to foreign bank making a $175,000,000 loan secured by a pledge of a note and mortgage encumbering the New York Times Building in New York City

Counsel to plaintiff in obtaining a verdict of over $22 million for a medical malpractice action against a major medical institution in Santa Clara Superior Court

Counsel to beneficiary of trust in bringing an accounting action against the trustee in Los Angeles Superior Court

Counsel to partner of medical partnership in defending and countersuing through eight days of arbitration related to a multi-million dollar partnership dispute before JAMS Arbitration in Los Angeles, California

Counsel to governmental issuers with their economic development, public revenue finance and taxation programs, specifically in the area of housing, including work on financings and other matters for the Nassau County Industrial Development Agency, the Nassau County Bridge Authority, and the Water Authority of Western Nassau County

Plaintiff’s counsel in bringing construction defect lawsuits against several residential developers in Arizona and achieving settlements whereby plaintiff’s homes were remediated


Draft entity organization documents and develop strategies for new and existing entities to achieve management and ownership goals; counsel clients on new laws affecting certain industries and operations

Act as general counsel to several companies in New York and Colorado with general business and contract matters

Trusts, Estates, and Probate: assist clients with their trusts and estate planning goals, ranging from small to multi-million dollar estates; represent beneficiaries and heirs who want to protect their interests during the administration of the estate of a deceased; advise and represent fiduciaries and family members serving as conservators, guardians, personal representatives, trustees or agents under durable powers of attorney; probate litigation for parties contesting or defending a will or a trust

Coordinate land use, title, and real estate due diligence for the acquisition of improved and unimproved commercial property

Negotiate and draft purchase agreements, ground leases, leases and easements and restrictions for mixed and multi-use developments

Perform due diligence, title work, and close transactions for residential and commercial properties

Assist in providing clients with land use planning strategies and obtaining governmental approvals, zoning changes, variances, and real estate-based economic incentives

Represent clients before the New York City Environmental Control Board for zoning violations

Assist clients in complying with the mandates of the NY State Environmental Quality Review Act (SEQRA) and the City Environmental Quality Review (CEQR) processes
